Terms of Service

By accessing or using Track Fit Member, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service.

Track Fit Member provides gym management software that allows gym owners and fitness trainers to:

• Track member information and attendance
• Manage billing and payment collection
• Send automated WhatsApp payment reminders
• Generate reports and analytics
• Export data in CSV format

We reserve the right to modify or discontinue any feature at any time.

To use our service, you must:

• Be at least 18 years old
• Create an account using Google authentication
• Provide accurate and complete information
• Maintain the security of your account
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

We offer the following subscription tiers:

• Free Tier: ₹0/month — Up to 10 members
• Starter Tier: ₹249/month — Up to 100 members
• Pro Tier: ₹899/month — Up to 500 members
• Unlimited Tier: ₹1,999/month — Unlimited members

Pricing and plans are subject to change with 30 days notice. Payments are processed manually via UPI. Service activation occurs after payment verification.

You agree NOT to:

• Use the service for any illegal purpose
• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit malware or malicious code
• Attempt to gain unauthorized access to other users' data
• Resell or redistribute the service
• Use the service to spam or harass others

As a gym owner using Track Fit Member:

• You are the data fiduciary under DPDP Act 2023 for your members' information
• You are responsible for obtaining proper consent from your members
• You must comply with all applicable data protection laws
• You warrant that you have the legal right to collect and process member data
• Track Fit Member acts as a data processor on your behalf

The service and its original content, features, and functionality are owned by Track Fit Member and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the service without explicit permission.

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or completely secure.

To the maximum extent permitted by law, Track Fit Member shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred in contract, tort, or otherwise.

Our total liability to you for any claim arising out of or relating to these terms or your use of the service shall not exceed the amount you paid to us in the last 12 months, or ₹1,000 if you have not paid anything.

You agree to defend, indemnify, and hold harmless Track Fit Member and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Service.

We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Non-payment of subscription fees
• Fraudulent or illegal activity
• Extended inactivity (12+ months)

Upon termination, you can export your data for 30 days, after which it may be permanently deleted.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts in Ranchi, Jharkhand, India.

Any dispute arising out of or in connection with these Terms shall first be attempted to be settled amicably through good faith negotiations. If not resolved within 30 days, the dispute shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996.

We reserve the right to modify these terms at any time. We will provide notice of significant changes via email or through the application at least 30 days before they become effective.
